What to know about USERRA deadlines before you return

Steps

  1. Determine the length of your military service.
  2. If your service was less than 31 days, report to work by the beginning of the first regularly scheduled work period after the end of the calendar day of duty, plus the time required to return home safely and an eight-hour rest period. If this is impossible or unreasonable, report as soon as possible.
  3. If your service was 31 to 180 days, apply for reemployment no later than 14 days after completing military service. If this is impossible or unreasonable through no fault of your own, apply as soon as possible.
  4. If your service was 181 days or more, apply for reemployment no later than 90 days after completing military service.
