FLI covers bonding, caregiving, or domestic violence needs (12 weeks continuous or 56 days/8 weeks intermittent per 12 months, same wage rate and cap, job protection provided, file within 30 days). Eligibility requires either 20 weeks worked at $310+/week, or $15,500 total earned in the relevant base period.
  • New York — NY DBL, NY PFL & Prenatal Leave: DBL covers own condition (26 weeks/52 weeks, 50% of last-8-weeks average wage, max $170/week, no job protection, file within 30 days; requires 4 consecutive weeks with a single employer). PFL covers bonding, caregiving, military needs (12 weeks/52 weeks, 67% of wages, max $1,228.53/week, job protection provided, file within 30 days; requires 26 consecutive weeks — or 175 days if working under 20 hrs/week — with current employer). Combined DBL + PFL capped at 26 weeks/52 weeks. Prenatal Leave covers qualifying pregnancy appointments (20 hours/52 weeks, 100% of wages, job protection provided, no claim filing or documentation required, all employees eligible).
  • Oregon — Paid Leave Oregon (PLO): Covers own condition, bonding, caregiving, safety needs, foster/adoption legal process. 12 weeks/52 weeks (14 weeks for pregnancy/childbirth-related limitations). Max $1,692.16/week. Job protection requires 90 days tenure. File 30 days before to 30 days after leave start; requires $1,000 in base period wages.
  • Rhode Island — RI TDI & RI TCI: TDI covers own condition (up to 30 weeks/52 weeks, 4.62% of highest-quarter wages, max $1,150/week, no job protection, file within 90 days). TCI covers bonding, caregiving, or own bone marrow/organ donation (up to 8 weeks/52 weeks, same rate and cap, job protection provided, file within 30 days). Combined TDI + TCI capped at 30 weeks/52 weeks. Requires $19,200 in base period wages, or a lower alternate threshold.
  • Washington — WA PFML: Covers own condition, bonding, caregiving, military needs, or certain circumstances after the death of a child. 12 weeks/12 months per category; combined capped at 16 weeks (18 weeks for pregnancy complications). Up to 90% of wages, max $1,647/week. Job protection requires employer with 25+ WA employees and employee with 180 days tenure. File within 30 days of the qualifying event; requires 820 hours worked in the relevant base period.

What if it doesn't work

  • I need job protection but my program doesn't guarantee it: NY DBL and RI TDI don't provide job protection on their own — check whether another job-protected leave law applies concurrently.

Limits and exceptions

  • NY DBL and RI TDI do not provide job protection on their own.
  • Combined leave caps apply within NY (DBL+PFL), RI (TDI+TCI), and WA (all PFML reasons).
  • NY Prenatal Leave has no claim filing or documentation requirement, unlike the other programs listed here.
