Which job-protected leave laws apply in ME, MD, MA, MN, NH, and NJ?

What you're entitled to depending on where you work

Quick answer
Each of these states has one or more laws providing job- and benefit-protected leave for family and medical reasons, with eligibility, leave length, and wage replacement varying significantly by state. Details for each are below.

Who this applies to / Prerequisites

  • Employers and employees meeting each specific law's coverage and eligibility requirements (see below).

Key facts (by state)

  • Maine — ME FMLA & ME PFML: ME FMLA covers own condition, bonding, caregiving, organ donation, and injured service member care/death (10 weeks/2 years, no wage replacement, requires 12 consecutive months tenure with an employer of 15+ at one ME location). ME PFML covers own condition, bonding, caregiving, military exigency, and domestic violence/safety reasons (12 weeks/12 months, provides wage replacement, max $1,249.12/week; job protection requires 120 days tenure; employers cannot deny leave for undue hardship, but can factor it into timing).
  • Maryland — Maryland Parental Leave Act: Covers bonding only (6 workweeks/12 months). No wage replacement. Requires 12 months tenure, 1,250 hours worked, and a worksite with 15+ employees within 75 miles. Applies only to employers with 15–49 employees not already covered by FMLA. Employers may deny leave if it would cause substantial and grievous economic injury.
  • Massachusetts — MA PFML & MPLA: MA PFML covers own condition (20 weeks/12 months), bonding/caregiving (12 weeks/12 months), and military reasons (26 weeks/12 months), with combined own-condition + bonding/caregiving capped at 26 weeks. Provides wage replacement, max $1,230.39/week. MPLA covers bonding only (8 weeks per child, e.g., 16 weeks for twins). No wage replacement. Applies to employers with 6+ employees; full-time employees eligible.
  • Minnesota — MN PFML & MN PLA: MN PFML covers own condition (12 weeks) and other reasons including bonding/caregiving/military/domestic violence (12 weeks), combined capped at 20 weeks/12 months. Provides wage replacement, max $1,423/week; job protection requires 90 days tenure. MN PLA covers bonding and prenatal care/pregnancy incapacity (12 weeks per event; prenatal appointment time doesn't count against the 12 weeks). No wage replacement. All employees eligible except independent contractors; bonding available to birthing and non-birthing parents.
  • New Hampshire — Childbirth, Postpartum, and Pediatric Appointments Leave: Covers the employee's own childbirth/postpartum appointments and pediatric appointments for a child within the first year of birth/adoption (25 hours per event, used within 12 months of birth/adoption). No wage replacement. Applies to employers with 20+ total employees; all NH-based employees eligible.
  • New Jersey — NJ FLA, NJ TDI & NJ FLI: NJ FLA covers bonding and caregiving only — not pregnancy (12 weeks/24 months, no wage replacement, requires 3 months tenure and 250 hours worked, applies to employers with 15+ employees). NJ TDI covers own condition, high-risk COVID-19 exposure, communicable disease exposure, and organ/bone marrow donation (26 weeks/claim, provides wage replacement, max $1,119/week). NJ FLI covers bonding, caregiving, and domestic violence needs (12 weeks continuous or 8 weeks/56 days intermittent per 12 months, provides wage replacement, max $1,119/week).

Limits and exceptions

  • The Maryland Parental Leave Act applies only to a narrow employer size band (15–49 employees) and only where FMLA doesn't already apply.
  • NJ FLA does not cover pregnancy — see NJ TDI for the employee's own health condition instead.
